These terms govern your access to and use of Cresia's website at cresia.co and the applications and services we make available through it (together, the "Service"). Please read them together with our Privacy Policy, which explains how we handle your information.
Your use of the Service
By accessing or using the Service you agree to be bound by these terms. If you are using the Service on behalf of an organisation or entity, you are agreeing to these terms on behalf of that organisation, and you represent and warrant that you have the authority to bind it to them. The Service may change from time to time without prior notice, and we may suspend or discontinue any part of it at any time.
Access to the Cresia platform itself is provided under the agreement executed with your organisation; where that agreement and these terms differ, the executed agreement governs your use of the platform.
Data storage
Information you submit through forms on this website — such as demo requests and contact enquiries — is stored on Cresia's own infrastructure and is accessible only to the Cresia team. We do not sell this data or share it with third parties except where the law requires us to. Customer data processed inside the Cresia platform is handled under the terms of the agreement executed with your organisation.
Termination
If you violate any of these terms, your permission to use the Service terminates automatically. We may also suspend or end your access to the website at any time, with or without cause.
Service provided "as is"
The website, applications and content are provided "as is", without warranty or condition of any kind, either express or implied. To the maximum extent permitted by applicable law, Cresia disclaims any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement. We make no warranty that the Service will be available at any particular time or location, or that the content and data obtained through it will be accurate, timely or reliable.
Right to use logo
Unless agreed otherwise in writing, customers agree that Cresia may use their organisation's name and logo in Cresia's customer list and marketing material, including on cresia.co. You can withdraw this permission at any time via the contact page.
Indemnity
You agree to defend, indemnify and hold harmless Cresia and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses — including reasonable legal fees — arising out of or connected with your violation of these terms.
Limitation of liability
To the maximum extent permitted by applicable law, Cresia will not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your access to or use of, or your inability to access or use, the Service — whether based on warranty, contract, tort or any other legal theory, and whether or not we have been informed of the possibility of such damage. Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law.
Controlling law and jurisdiction
These terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law provisions. You agree that any dispute arising from or relating to these terms or the Service will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
Modification of these terms
We may revise these terms from time to time. The current version will always be published on this page, with its "last updated" date. Continued use of the Service after a change takes effect constitutes acceptance of the revised terms.
